General

1.1) As the commissioned Artist, I retain the right to update my terms and conditions for fairness to both the Artist and the Client.

1.2) When you agree to commission me, you acknowledge and agree to all the terms and conditions outlined here.

1.3) I reserve the right to decline any requested Commission.

1.4) While I have the right to adjust my prices, once we mutually agree on a price, it remains locked in until we discuss and mutually agree on another price.

1.5) I cannot be held responsible for mistakes resulting from misinformation or miscommunication. It is the Client's responsibility to provide all necessary information, including references and deadlines.

1.6) All communication will be conducted through text-based channels to document the transaction between Artist and Client.

1.7) Any personal information exchanged between the Client and me will remain private and confidential, except when presented in a court of law or if there is reason to believe the client's health is at risk.

1.8) The time required for each Commission varies, and the Client will be informed if more time or money is needed during the process.

1.9) Clients will be notified of the completion of each phase of the Commission process to ensure satisfaction with the result and progress.

1.10) Clients are entitled to three free revisions before incurring charges for additional changes that require substantial effort. Each revision beyond the third will be charged.

1.11) I reserve the right to charge for significant changes to the overall Commission if it is near completion or several changes have already been made.

1.12) Respect is a two-way street. If the Client displays continuous disrespect, I reserve the right to discontinue progress on the commission without a refund.

1.13) Clients are expected to show restraint and avoid rushing the Artist. Quality work takes time, and repeated rushing may lead to the discontinuation of the commission without a refund.

1.14) If I suspect the client of endless constant revisions, I reserve the right to pause the commission and ask for proper compensation or discontinue it without a refund.

1.15) I will not actively pursue the Client if there is no response for a month. After a month of no communication, I reserve the right to discontinue the commission without a refund.

1.16) Requesting a refund means the client is no longer entitled to the agreed-upon deliverables at the end of the commissioned project.

1.17) I am not liable for what happens to the files, data, or information used to create the commissioned piece after the final payment. The Client is responsible for informing me of the deliverables.

1.18) After I hand off the final deliverables, the Client has 14 days to request any remaining revisions. After 14 days, the commission will be marked as finished, and any additional changes will be treated as a separate commission.

 

Use and Rights of Image

2.1) Unless stated otherwise, I am allowed to upload and display the Commissioned work, along with its progress, on any of my online accounts and use it in my portfolio.

2.2) The Client must properly give credit to me as the artist.

2.3) Unless agreed upon, the user may not use the image for profit or commercial use.

2.4) Posting the Commission online is permitted as long as the given link is posted alongside the Commissioned piece: https://jubtheartist.wixsite.com/jubtheartist.

2.5) The Client is not allowed to use my art for anything related to NFT or AI.

2.6) If a project is canceled by the client before completion, I reserve the right to repurpose any art created during and for the project.

Payment

3.1) Any and all Commissions will only be accepted in USD; other forms of currency will not be accepted.

3.2) All transactions will be done via Paypal: PayPal.me/brixujel.

3.3) No Commission will be started until we mutually agree upon the method of payment.

3.4) The Client isn’t allowed to withhold payment without documented or recorded proof of me not holding up my end of the bargain.

3.5) I reserve the right to halt the process of the Commission due to poor or constant miscommunication, rude/inappropriate behavior, any form of abuse, or any form of threats.

3.6) If I must cancel the commission for any reason or deem that I can no longer complete what was agreed upon, the client is allowed to request a refund.

3.7) I am allowed to refuse to start any project without a form of payment upfront.

3.8) After the final delivery or termination of the commission, the client is not entitled to any form of a refund. The client may request additional work on the commission, but it will be treated as a separate commission.

3.9) While the client is entitled to a refund, the client is only entitled to 50% of the most recent payment, excluding any additional increases added by revision fees.

3.10) Refunding payment after a commission is completed will result in being placed on a blacklist.
